By using a website, you agree to these terms. If you buy a course or appoint us for an assessment, consulting engagement or implementation project, additional product or service terms may apply. The signed proposal, order, statement of work or other specific agreement will take priority if it conflicts with these website terms.

2. Website information is not professional advice

Website articles, examples, calculators, downloads, course descriptions and assessment estimates are provided for general information. They are not legal, tax, accounting, employment, financial, medical or other regulated professional advice.

Examples and case studies describe particular circumstances. They do not guarantee that another business will obtain the same result. Estimates depend on the accuracy of the information and assumptions used.

You remain responsible for business decisions and for obtaining professional advice where it is needed.

3. Accuracy and availability

We take reasonable care when preparing website content, but information can become outdated or contain errors. We may change, correct, suspend or remove content without notice.

We do not promise that a website will always be available, uninterrupted, secure or compatible with every device or browser. Planned maintenance, provider failures and events outside our reasonable control may affect availability.

4. Intellectual property

Unless stated otherwise, Alphashift (Pty) Ltd or its licensors own the website content, branding, text, graphics, training materials, downloads, software and other material made available through the websites.

You may view the websites and may download material that is expressly provided for download for your own lawful personal or internal business use. You may not, without written permission:

  • republish, sell or commercially exploit the material;
  • remove copyright, trade mark or ownership notices;
  • copy a substantial part of a course, report, template or website;
  • give another person access to an account or paid material assigned to you;
  • use the material to train a competing product or service; or
  • reverse engineer software except where the law expressly permits it.

Quotations and links are permitted to the extent allowed by law, provided the source is acknowledged and the use is not misleading.

5. Acceptable use

You may not use a website to:

  • break the law or infringe another person's rights;
  • introduce malware or interfere with the website or another user's access;
  • attempt unauthorised access to an account, server, database or system;
  • scrape or extract content at scale without permission;
  • submit unlawful, harmful, misleading or infringing material; or
  • misrepresent your identity or authority.

We may restrict access where reasonably necessary to protect the websites, our rights, other users or the public.

6. Accounts and security

You are responsible for information submitted through your account and for keeping your login details secure. Tell us promptly if you believe an account has been compromised.

We may suspend or close an account if it is used unlawfully, fraudulently or in material breach of these terms. Where reasonably practicable, we will give notice and an opportunity to address the problem.

7. Courses and online purchases

The description, price, access period, content and any product-specific conditions displayed at the time of purchase form part of the transaction. Prices are stated in the displayed currency. Alphashift (Pty) Ltd is not currently registered for VAT, so VAT is not added by us.

Payment may be processed by Teachable or another payment provider. The provider's payment and platform terms may also apply.

Course access is for the registered learner unless the product description expressly allows team or transferable access.

Cancellation and refunds

We will honour any cancellation, cooling-off or refund right that applies by law. Any additional refund policy displayed for a specific course or product also applies.

For a course bought with one full, once-off payment, you may request a full refund by contacting us within 30 days after purchase.

The voluntary 30-day refund does not apply to a payment plan. A payment plan divides the full course price into instalments and is not a month-to-month subscription. By choosing a payment plan, you commit to paying the full price according to the displayed schedule. You may not cancel the remaining instalments merely because you stop using the course.

These rules do not limit a cancellation, cooling-off, refund or other consumer right that cannot lawfully be excluded. To request a refund or raise a payment issue, email admin@moolmaninstitute.com with your name, account email and course details.

The websites may use or link to services operated by third parties, including Teachable, Mailchimp, Cloudflare, OpenAI, payment providers and external websites. Their own terms and privacy notices may apply.

We are not responsible for an independent third party's content, availability or conduct. A link does not necessarily mean that we endorse everything on the linked website.

9. Information you submit

You retain ownership of information and material you submit. You give us the limited permission needed to receive, store, copy and use it for the purpose for which it was provided, including responding to an enquiry, providing a course or performing agreed services.

Do not submit information that you are not authorised to share. Confidential assessment or implementation material is governed by the applicable confidentiality and service terms.

10. Privacy

Our privacy notice explains how we process personal information. It forms part of these terms and is available from the footer of our websites.

11. Responsibility and liability

Nothing in these terms excludes or restricts a right or remedy that cannot lawfully be excluded or restricted. We do not exclude liability for fraud, wilful misconduct, gross negligence or another liability that the law does not permit us to exclude.

To the extent permitted by law, we are not liable for indirect or consequential loss arising solely from use of the public website or reliance on general website content. Liability relating to a paid product or service is governed by the applicable product terms or service agreement.

You are responsible for maintaining appropriate backups, security controls and independent checks when acting on downloadable material, calculators, examples or general website information.

12. Changes to these terms

We may update these terms when our websites, services or legal obligations change. The current version and effective date will be published on the website.

A change will not retrospectively alter a completed purchase or signed service agreement unless the parties agree or the law requires it.

13. Governing law and disputes

These terms are governed by the laws of South Africa.

Please send a complaint or dispute to admin@moolmaninstitute.com first so that we can try to resolve it. If it cannot be resolved, either party may use any court, tribunal, ombud or other dispute process that has jurisdiction. These terms do not prevent a consumer from using a remedy available under applicable consumer law.
